SWEEPSTAKE TIMING
The Diamond Dreams Free Stay Giveaway entry period begins on February 1, 2024, at midnight PST and ends on March 31, 2024, at 11:59 pm PST. Entries not received within the Entry Period will be void.
Please Note: the winner of the Diamond Dreams sweepstakes must be able to travel to Las Vegas and check into the resort from May 17th to May 20th, 2024. This is an inflexible requirement, and no exceptions will be made. If you cannot meet these dates for any reason, we respectfully request that you do not participate in the sweepstakes.
ELIGIBILITY
The sweepstake is open to legal residents of the fifty (50) United States, the District of Columbia, and Canada who are 21 or older. Employees of Diamond Dreams Travel, their respective subsidiaries, affiliates, distributors, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win—void where prohibited by law. The sweepstake is subject to federal, state, and local laws.
HOW TO ENTER:
To participate in the sweepstakes, complete the online entry form on the Diamond Dreams Travel website.
LIMIT
During the Sweepstakes Period, each person is limited to one (1) entry per online entrant. All entries become the Sponsor's property and will not be returned or acknowledged. Only the Entrant may submit the entry. Any entries made by an individual or entity other than the participant will be deemed invalid and disqualified from the sweepstakes. This includes commercial sweepstakes subscription notification and/or entering services and using any automated, robotic, or third-party system to participate. Such actions are strictly prohibited and will result in disqualification. Tampering with the entry process or the operation of the Sweepstakes is not permitted, and any entries deemed by the Administrator, in its sole discretion, to have been submitted in this manner will be void. If a dispute regarding the identity of the individual who submitted an entry cannot be resolved to the Administrator's s satisfaction, the affected entry will be deemed ineligible.
Multiple participants are not permitted to share the same email address. Any attempt by a participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, and logins or any other methods will void that participant's entries, and that participant may be disqualified.
The sponsor's database computer is the official time-keeping device for Sweepstakes. Sponsor (DIAMOND DREAMS TRAVEL) assumes no responsibility for any error, omission, interruption, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to or alteration of entries. The Sponsor (DIAMOND DREAMS TRAVEL) is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor (DIAMOND DREAMS TRAVEL) on account of technical problems or traffic congestion on the Internet/Facebook or any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes.
AGREEMENT TO OFFICIAL RULES:
No purchase is necessary to enter or win the Diamond Dreams Free Stayl giveaway sweepstake. Making a purchase does not enhance the probability of winning. BY PARTICIPATING, THE ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES, AND YOU REPRESENT AND WARRANT THAT YOU MEET THE ELIGIBILITY REQUIREMENTS. IN ADDITION, THE ENTRANT AGREES TO ACCEPT THE SPONSOR'S (DIAMOND DREAMS TRAVEL'S) DECISIONS AS FINAL AND BINDING AS THEY RELATE TO THE CONTENT OF THIS GIVEAWAY.
BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT THE SPONSOR AND PRIZE PROVIDER, THEIR AFFILIATES, PARENTS OR SUBSIDIARIES, RESPECTIVE PARENT, SUBSIDIARY, AND AFFILIATE COMPANIES, AND ADVERTISING AND PROMOTION AGENCIES HAVE NO LIABILITY WHATSOEVER FOR AND WILL BE HELD HARMLESS BY THE WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY DAMAGES SUSTAINED, DUE IN WHOLE OR INPART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST.
GENERAL CONDITIONS:
If for any reason the giveaway is not capable of running as planned due to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failure, human error, or any other causes beyond the control of the Sponsor (Diamond Dreams Travel) that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstake. Sponsor (DIAMOND DREAMS TRAVEL) reserves the right, at its sole discretion, to disqualify any individual deemed to be tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or Sponsor's (DIAMOND DREAMS TRAVEL) Website or acting in violation of these Official Rules or an unsportsmanlike or disruptive manner. Failure by the Sponsor (DIAMOND DREAMS TRAVEL) to enforce any provision of these Official Rules shall not constitute a waiver. PLEASE NOTE: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR (DIAMOND DREAMS TRAVEL) RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
DISPUTE
In the event of a dispute about the identity of a winner based on an email address, the winning entry will be declared by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is the natural person assigned to an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
PRIZE
The lucky winner of this giveaway will be treated to a delightful three-night stay at the WorldMark Las Vegas - Boulevard resort (accommodates up to four people), which boasts top-notch amenities and services, a luxury welcome basket filled with a selection of gourmet foods, and adult beverage for two, entry via the host to an off the Strip Las Vegas show and the prize includes all taxes, resort fees, and deposits. The winner must be ready and able to redeem the resort Stay during the set timeframe of May 17-20, 2024. If the winner cannot travel and stay on the set dates, please do not enter the giveaway, as the prize is non-transferable, cannot be rolled over to future stays, and holds no cash value.
PRIZE VALUE
The approximate total value of the Giveaway prize is $3,500. Actual/appraised value may differ at the time of prize award. Diamond Dreams Travel shall solely determine the specifics of the prize. No cash or other prize substitution shall be permitted except at the discretion of Diamond Dreams Travel. All prize-related expenses not included in the giveaway, including any federal, state, and/or local taxes, shall be the sole responsibility of the Winner. The giveaway DOES NOT INCLUDE AIRFARE and transportation to, from, and within Las Vegas. Acceptance of the prize constitutes permission for DDT to use the Winner’s name, likeness, and entry for advertising and trade without further compensation unless prohibited by law.
USE OF DATA
Following our privacy policy, Diamond Dreams Travel will collect personal data about entrants online. Please review the policy. By participating in the Sweepstakes, Entrants acknowledge that they have read and accepted the Sponsor's privacy policy. Entrants shall be deemed to have agreed to have their entry information made available to Diamond Dreams Travel and the Administrator of the Sweepstakes by entering into the Sweepstakes.
DRAWING AND NOTIFICATION:
The potential Grand Prize Winner will be selected in a random drawing from among all eligible entries received by the Administrator whose decisions are final and binding. The Grand Prize drawing will be conducted on or about April 4, 2024. The potential prize winner will be notified within three (3) days of the drawing date by email or phone by the Administrator using the contact information provided at the time of entry. The sponsor shall have no liability for any potential prize winner notification lost, intercepted, or not received by any potential prize winner for any reason. If despite reasonable efforts, any potential prize winner does not respond within forty-eight (48) hours of the first notification attempt, or if the prize notification is returned as unclaimed or undeliverable to such potential prize winner, such potential prize winner will forfeit his or her prize, and an alternate Winner will be selected in a second random drawing from all eligible entries received. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declined a prize for any reason before award, such potential prize winner will be disqualified, and an alternate winner will be selected.
GRAND PRIZE CONDITIONS
Only the prize listed above will be awarded in this Sweepstakes. Upon confirmation of eligibility, the Grand Prize Winner and their companion will receive a voucher that equals the approximate retail value of the prize. The prize will be fulfilled as a certificate/voucher redeemable by filling in the requested information and mailing it back to the address indicated. The Winner will not receive the difference between the actual and approximate retail value of the prize. The sponsor (Diamond Dreams Travel) will not replace any lost, mutilated, or stolen prize. No transfers or substitutions will be made except as provided herein at the Sponsor's (Diamond Dreams Travel) sole discretion. The prize, including any portions thereof, is not redeemable for cash. No cash alternative or substitution will be allowed. The winner will be required to provide proof of identity, verification of eligibility and compliance with these Official Rules, and, unless prohibited by law, a complete written Affidavit of Eligibility/Release of Liability Form, W-9 taxpayer request for identification form and where legal, Publicity Release ("Affidavits"), all of which must be received fully-executed within five (3) business days of receipt or such potential prize winner may be disqualified and the alternate Winner will be offered the Prize. The winner is responsible for any other costs and expenses not specified herein as being awarded. If needed the winner and their travel companion (if any) must have valid travel documents (e.g., government-issued I.D., passport, etc.) and any other requirements. Failure to comply with the request may result in forfeiture of the prize.
The winner and their travel companion(s) are solely responsible for fulfilling all their requirements.
upon check-in at the resort, the winner must have a valid major credit card. The Sponsor will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage, or any other natural disaster outside its control that may cause the cancellation of the prize. The winner must obey all local laws regarding lodging restrictions. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to ground transportation, airfare, personal charges at lodging, telecommunication charges, security fees, taxes, or other expenses or incidentals, are solely responsible for the winner. The winner's companion must be 21 or older and execute liability/publicity releases before travel.
DISPUTES BY ENTERING THE SWEEPSTAKES
Entrants agree that any disputes, claims, and causes of action arising from or connected with the Sweepstakes or any prizes awarded shall be resolved individually without resorting to class action. Any claims, judgments, and awards shall be limited to out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees. Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental, or consequential damages and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules shall be governed by and construed following the laws of the State Of Nevada without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Nevada. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision is invalid or otherwise unenforceable or illegal, these Official Rules shall remain in effect and be construed following their terms as if the invalid or illegal provision were not contained herein. The value of the prizes set forth above represents the Sponsor's reasonable faith determinations of the ARV thereof and such determinations are final and binding and cannot be appealed.
PUBLICITY RELEASE
Except where prohibited by law, acceptance of any prize shall constitute the Winner's agreement and consent to Sponsor and Sponsor's (DIAMOND DREAMS TRAVEL) designees to use, without compensation and in any manner, the Sponsor (Diamond Dreams Travel) deems fit, the Winner's name, city, state, likeness, photo, avatar, and/or prize information in connection with this Sweepstakes (collectively, the "Attributes") for any promotional, advertising or other purposes. Except where prohibited by law, the Winner grants the Sponsor (Diamond Dreams Travel) a perpetual, worldwide, royalty-free license to use the Attributes in any media now known or hereafter devised, including the Internet, without limitation and further compensation, notification, permission, or other consideration, and releases the Sweepstakes Entities from all claims arising out of the use of such Attributes.
RELEASE OF LIABILITY
By entering this Sweepstakes, each Entrant agrees to release and hold harmless the Sweepstakes Entities and each of their respective directors, officers, employees, affiliates, subsidiaries, distributors, suppliers, and agents, including but not limited to their respective advertising and promotion agencies, and each of their affiliated companies, subsidiaries, licensees, distributors, suppliers, sales representatives, individuals engaged in the development, production or distribution of materials, and any other companies associated with the promotion agents, and all of their respective parent companies, subsidiaries, affiliates, agents, franchisees, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies, and each such company's officers, directors, employees, and agents (collectively, the "Released Parties"). The Entrant agrees and acknowledges that the Released Parties are not responsible for: any incorrect or inaccurate information, whether caused by Entrant, printing, production, typographical or other errors or by any of the equipment or programming associated with or utilized in this Sweepstakes, technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software, unauthorized human intervention in any part of the entry process or this Sweepstakes, printing, typographical, technical, computer, network or human error which may occur in the administration of this Sweepstakes, the uploading, the processing or random selection of entries, the announcement of the prize or in any Sweepstakes-related materials, late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or mail, costs associated with claiming or redeeming the prize, nor loss or damages resulting from an Entrant's connection to the internet via any of the websites contained herein. Released Parties are not responsible for any incorrect, mistranscribed, misdirected, or undeliverable entries, Email transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor (Diamond Dreams Travel) or Administrator assumes no responsibility for late, lost, incomplete, inaccurate, or damaged entries or undeliverable Emails resulting from any form of active or passive Email filtering by a user's Internet service provider and/or Email client or for insufficient space in the user's email account to receive email. Sponsor (Diamond Dreams Travel) or Administrator does not accept responsibility for any damage (material or non-material) caused to Entrants, their computer equipment data stored on them, or their personal, professional, or commercial activities. Proof of submitting entries will not be deemed proof of receipt by the Sponsor (DIAMOND DREAMS TRAVEL).
GOVERNING LAW/JURISDICTION
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant, Administrator, and Sponsor in connection with the Sweepstakes, shall be governed by and construed by the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Nevada. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is invalid or otherwise unenforceable, these rules shall be construed under their terms as if the invalid or unenforceable provision was not contained therein.
