These terms and booking conditions outline the rules and regulations for using Diamond Dreams Travel's Website and our professional travel services.​The Website is only available for use if you agree to these terms. By using, accessing, or obtaining any of the content, products, or services through our Website, you, the purchaser, understand your Agreement to be bound by these terms. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DISAGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR DIAMOND DREAMS TRAVEL SERVICES.

Diamond Dreams Travel reserves the right to seek all remedies available at law and in equity for violations of these terms and conditions, including blocking access to the Website from a particular Internet address. These terms cannot be changed except in writing by an officer of Diamond Dreams Travel.

Diamond Dreams Travel is referred to in this Agreement as "Diamond Dreams Travel," "DDT," "we," or "us." The terms and conditions set forth below constitute the entire understanding and Agreement between you, the tour participant ("participant," "you," or "I"). Diamond Dreams Travel, concerning all bookings, tours, or transactions made with us and to all services and tours organized, arranged, or provided by us (collectively referred to as "tour" herein; "tour" may also be used to refer to the trip component of our services).

We employ the use of cookies. Using DIAMOND DREAMS TRAVEL'S Website, you consent to use cookies under DIAMOND DREAMS TRAVEL'S privacy policy. Today, most interactive websites use cookies to retrieve user details for each visit. Cookies are used in different areas of our site to enable the functionality of this area and ease of use for those visiting. Some of our affiliate/advertising partners may also use cookies. 

LIMITATION OF LIABILITY WEBSITE USE

This TRAVEL AGENCY expressly disclaims any liability (whether based on contract, tort, strict liability, or otherwise) for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with access to or use of the Website (even if this TRAVEL AGENCY has been advised of the possibility of such damages) including liability associated with any viruses which may infect a users computer equipment. Each supplier company is independent with its management and is not subject to Diamond Dreams Travel's control.

AGE AND FINANCIAL RESPONSIBILITY

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement to make travel bookings with Diamond Dreams Travel by any means, including our Website, under all terms and conditions herein. You agree to be financially responsible for your travel bookings (as well as for others using your account, including, without limitation, minors living with you). You agree to supervise all Diamond Dreams Travel communications usage by children under your name or account. THIS WEBSITE AND THIS TRAVEL AGENCY DO NOT KNOWINGLY SOLICIT DATA FROM CHILDREN, AND WE DO NOT KNOWINGLY MARKET TO CHILDREN. You also warrant that all information supplied by you or members of your household transacting business with Diamond Dreams Travel is true and accurate. Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be traveling with an adult other than their parents or with only one parent, a notarized letter written by the parents or non-traveling parent granting authorization to travel, including the dates of Travel.

PARTNER SUPPLIERS TERMS

Diamond Dreams Travel accepts all bookings as an agent for the travel suppliers on your trip itinerary. The transportation, accommodations, and other services provided by the identified sea, ground, and air operator suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders, or vouchers issued by them and their suppliers, including Terms and Conditions on their respective Web sites. BECAUSE DIAMOND DREAMS TRAVEL ACTS AS AN AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT DIAMOND DREAMS TRAVEL IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE THAT MAY ARISE OUT OF THESE SERVICES. DIAMOND DREAMS TRAVEL DISCLAIMS ANY LIABILITY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH DIAMOND DREAMS TRAVEL'S OFFICE OR THIS WEB SITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF DIAMOND DREAMS TRAVEL'S CONTROL. YOU, AS A RESULT OF THIS, EXONERATE DIAMOND DREAMS TRAVEL FROM ANY LIABILITY CONCERNING THE SAME.

DDT SIGNATURE TRIP EVENT TERMS

Please Note that Diamond "Dreams Travel Signature Trip Event offers" are independent of our preferred partner supplier offers listed on our Website. DIAMOND DREAMS TRAVEL (DDT) SIGNATURE TRIP EVENT offers are non-refundable and non-transferable unless otherwise stated on the trip offer. When booking the "Diamond Dreams Travel Signature Trip Event" offers, please note that a non-refundable and non-transferable deposit is required (unless otherwise stated) to confirm your reservation. This deposit will be applied towards the cost of your package. Once a booking is made and the deposit paid, your right to a refund if you change or cancel your travel plans is forfeited. (TRAVEL INSURANCE IS HIGHLY RECOMMENDED) No refunds will be due for any Diamond Dreams Travel Signature Trip Event Offer or other services included in the tour/trip cost you do not utilize. If you choose not to use the service, decide to leave the tour early, or are excluded from the tour/trip due to your behavior or experiencing health issues during the tour/trip, there will be no refunds (TRAVEL INSURANCE IS HIGHLY RECOMMENDED). 

CREDIT CARD PAYMENT

Please Note: The USD American Dollar is the primary currency used by Diamond Dreams Travel. Diamond Dreams Travel accepts most major debit and credit cards. You authorize us to charge all amounts you pay for the services provided to the card designated by you. If payment from the issuer for any reason is not confirmed, you agree to pay Diamond Dreams Travel all amounts due immediately on demand. You may be requested to supply other details if the card is a foreign credit card.

ACCURACY

Changes and errors sometimes occur, and we reserve the right to amend advertised prices and other details at any time, both on our Website and in any advertising material we publish. 

DOCUMENTATION

You must check all details of your travel documents (including your itinerary) when you receive them. If there are any inaccuracies on your travel documents, or if you have any further queries, you should contact Diamond Dreams Travel immediately. Diamond Dreams will not be liable for any delay and loss due to any inaccuracies on any travel documents once you are in receipt.

SPECIAL REQUESTS

If you have any special requests (for example, dietary requirements, seating requests, room type or location, disabled access, special meals, etc., please let us know when booking. We will do our best to accommodate you, but we cannot guarantee your request.

​INSURANCE

You are strongly encouraged to take out personal TRAVEL INSURANCE for all party members when planning a vacation. You are responsible for ensuring that the insurance you purchase is adequate and appropriate for your travel-related needs. It would be best to be satisfied that your insurance fully covers all your requirements, including pre-existing medical conditions, cancellation charges, medical expenses, repatriation in the event of an accident or illness, etc. If you choose to travel without adequate insurance coverage, we will not be liable for any losses regarding which insurance coverage would otherwise have been available.

PASSPORT AND VISA

All individuals departing from the United States of America must have a valid passport. It is your responsibility to ensure that you have proper travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State or representative government agency of the country you are traveling to ascertain the visas and other requirements for admission to your destination. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the needs of those authorities will be your sole responsibility. Many countries require at least six months of validity from the entry date. A government-issued I.D. is required for Travel within the USA. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and the U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification to board a flight. Proper identification can be found at https://www.tsa.gov/

CHANGES AND CANCELLATIONS BY YOU 

If you or any member of your traveling party wishes to cancel your booking and travel arrangements after it's confirmed, we will do our utmost to make these changes, but it may only sometimes be possible. The lead name must notify us of the decision as soon as possible. Any notification by telephone must be confirmed in writing or by email within 24 hours by the lead name to info@diamonddreamstravel.com. Cancellation will take effect from the day we are notified, provided we receive written confirmation within 24 hours of the original notification. Should one or more party members cancel, the per-person price of those still traveling may increase. You will be liable to pay this increase. Where we can meet a request, all changes will be subject to payment of an administrative fee of $500 and up change based on our increased costs due to applicable rate changes and any costs or charges incurred or imposed by any of our suppliers. You will be notified of the amount before proceeding with any change. These fees will be added to your final invoice.

CHANGES TO BOOKING

If you make several changes to the same booking, you should be aware that these costs could increase closer to the departure date that changes are made, and you should contact us as soon as possible. If we cannot assist you and do not wish to proceed with the original booking, we will treat this as your cancellation. You will be liable to pay all cancellation charges imposed by various suppliers. Where your booking is for a package, you will be responsible for all cancellation charges levied by the suppliers providing the parts of such travel arrangements. The cancellation/amendment charges will be outlined in the Supplier's booking conditions. If you cancel or amend your booking, the Supplier may charge the cancellation or amendment charge shown in their Terms and Conditions (which may be 100% of the cost of the travel arrangements). We may collect this on their behalf, and you also must pay us any applicable charges.

Service Responsibilities

In case the services that are part of your Trip cannot be provided or if there are changes in the itinerary due to unforeseeable circumstances beyond the control of DDT  or the tour operator (if applicable), DDT or the tour operator (if applicable) will make reasonable efforts to arrange for similar services. Any additional costs incurred will be the responsibility of the trip participants, and any savings will be refunded to the participants by DDT (on behalf of the tour operator if applicable).

CHANGES AND CANCELLATIONS BY THE PARTNER SUPPLIER 

We will inform you as soon as possible if the Supplier needs to make significant changes to your confirmed Arrangements or cancel them. If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim these charges. Please Note: Certain travel arrangements may not be amended once confirmed. Any alteration or cancellation could incur a cancellation charge of up to 100% of that part of the arrangement. 

DDT SIGNATURE TOUR/TRIP CHANGES AND CANCELLATIONS 

Diamond Dreams Travel plans the arrangements for DDT SIGNATURE TOUR/ TRIPS many months in advance and may occasionally have to make changes, most of which are minor. While we do our best to operate trips as advertised, we reserve the right to change correct errors in the services, itineraries, and on our Website any time before or after your booking confirmation. Most changes are insignificant. If a substantial change occurs, we will inform you immediately. Due to the partner suppliers' contracting requirements imposed on us (Diamond Dreams Travel), our SIGNATURE TRIPS ITINERARIES require a certain number of participants to operate. If we cancel your trip, instead of postponing or rescheduling it, we will endeavor to reimburse you for any payments you have made. All non-refundable deposits and cancellation fees are paid to suppliers and other third parties to provide components of your trip; in many cases, it may not be possible to obtain supplier refunds once we have forwarded deposits for your trip to them. We will notify participants as soon as possible if this happens.

FINAL PAYMENT DDT SIGNATURE TRIP EVENT

The invoice must be paid by the final payment date, or your reservation and all services on the reservation will be canceled, and your deposit will be forfeited. 

DDT SIGNATURE'S TRIP EVENT REFUND

DIAMOND DREAMS TRAVEL SIGNATURE TRIPS (DDT) trip offers are non-refundable and non-transferable unless otherwise stated on the trip offer. Once a booking is made and the deposit paid, your right to a refund if you change or cancel your travel plans is forfeited. (FILE INSURANCE CLAIM) No refunds will be due for any tour/trip or other services included in the tour/trip cost you do not utilize. If you choose not to use the service, decide to leave the tour early, or are excluded from the tour/trip due to your behavior or experiencing health issues during the tour/trip, there will be no refunds. Unfortunately, we cannot be responsible for other expenses, like visa fees, vaccinations, travel equipment, etc.

RESPONSIBILITY AND CONDUCT

We may exclude you from participating in all or any part of the trip if, at our sole discretion, your condition or behavior renders you unfit for the tour/trip or unfit for continuation once the tour/trip has begun. Unfitness may include, without limitation, any conduct that, regardless of its cause, is inappropriate or offensive, interferes with the delivery of trip services, or may constitute a hazard or embarrassment.

DISPUTE

If there is any disagreement between the trip participant and DDT regarding the Trip or the Terms and Conditions, it will be resolved by a mediator in Las Vegas, Nevada. The mediator must be mutually agreed upon by both parties. If DDT is distributing travel packages as an intermediary for the tour operator, any travel-related disputes will be referred to the tour operator. All legal action related to the Terms and Conditions or the Travel must be taken in Nevada's courts. The participants agree that Nevada is the only place where such action can be taken and, therefore, give consent for the Nevada courts to have jurisdiction. If any claim is made against DDT, it must be made within 12 months of the trip's completion. Claims can only be brought in Nevada's state or federal courts, and parties agree to the jurisdiction and venue in Nevada. Neither party nor any affiliate of The Company will be liable for damages other than compensatory damages. The parties waive the right to claim punitive or exemplary damages. Parties can only bring claims in their individual capacities and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. Parties waive the right to bring any class actions, purported or proposed class actions, or representative actions. Nevada law governs this contract and its proceedings.

WAIVERS

When making a reservation for a DDT Signature trip or any of our partner supplier offers, it is mandatory that you sign the necessary waivers as per the type of trip. The booking process cannot be completed until all waivers have been duly signed. We would like to emphasize the significance of signing these waivers as they are a legal requirement, and they help to ensure that you are aware of any potential risks associated with your chosen trip. Should you have any questions regarding the waiver or the booking process, please do not hesitate to contact our team for assistance.

LATE BOOKING DDT SIGNATURE TRIP EVENT OFFERS

We emphasize the importance of booking as soon as possible because of our trips' intimate small-group nature. For bookings received within eight weeks of your trip start date (or at an earlier stage for specific trips), the contract between you (client) and us (Diamond Dreams Travel) comes into existence as soon as we have received payment.

PHOTOGRAPHIC/VIDEO RELEASE 

You consent to us (Diamond Dreams Travel )using video and images of you taken during the trip for advertising and promotional purposes in any medium we choose without compensation. You grant us (Diamond Dreams Travel) a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes. If you wish to avoid being photographed/videoed during our tours/trips, please notify us BY EMAIL at info@diamonddreamstravel.com. 

ACTIVITY LEVEL

Activity on this trip may incorporate active, robust elements such as walking, climbing stairs, evening activities, standing for periods, and long days with early hotel departures. You are responsible for choosing a trip that fits your abilities, level of fitness, and health. You must disclose any existing physical or mental illness, disability, pregnancy, or other condition that may create a health hazard for yourself or others during the tour/trip or for which you may require medical attention or unique accommodation. We will make reasonable efforts to accommodate your needs, but you must notify us when booking to determine what assistance we can reasonably provide. We regret that we cannot accommodate you if you have special needs for ordinary daily activities, such as walking and dining. We reserve the right to decline the acceptance of anyone we consider unsuitable due to fitness level. We also reserve the right to remove you from the trip, at your own expense, if your condition is such that it could create a hazard to you or others or otherwise impact the enjoyment of other travelers. 

HEALTH/SECURITY//TRAVEL DOCUMENTATION REQUIREMENTS

You are responsible for ensuring you know of any health requirements, health advisories, or health travel restrictions applicable to your travel destinations and carrying all necessary vaccination documentation. Diamond Dreams Travel is not responsible for providing you with this information. Travel carriers and local authorities at travel destinations may require specific testing before boarding or upon arrival at your destination, including, but not limited to, a temperature check due to the COVID-19 pandemic. You may be denied entry onto your carrier and entry upon arrival at your destination or be required to self-quarantine at your destination and upon your return to the United States. You must comply with local government regulations. Additional costs are your responsibility. Check with the Center for Disease Control and Prevention for current information before and during travel. www.cdc.gov

Below is a list of USA state departments to check for relevant information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, and proof of health/vaccination certificates), health hazards, and other information regarding the incidence of disease, terrorism, safety issues, crime, health hazards, and other restrictions regarding Travel to your domestic and international destination(s), and re-entry into the United States especially your embassy for non-USA. Please note that USA rules regarding entry and exit change daily.

For information concerning possible dangers at an international destination, contact the government office in your country that is responsible for issuing travel advisories.

AIRLINE USE OF INSECTICIDE SPRAY

Some countries require insecticide spraying of aircraft before a flight or while on the plane. Federal law requires that we refer you to the Department of Transportation's Disinfection Information page on their Website at the time of booking for further information.http://airconsumer.dot.gov/spray.htm

OPTIONAL ACTIVITIES AND EXCURSIONS

You may have the chance to engage in optional activities and excursions. PLEASE NOTE: DDT Diamond Dreams Travel does not own, operate, or control any companies or individuals that provide optional activities or excursions offered to customers during the trip. Any activity or tour excursion not explicitly identified as included in the purchase price is optional. If you book optional activities, you must be fit enough to engage in them. Booking an optional activity will be subject to the operator's terms and conditions and under local law. Diamond Dreams Travel accepts no liability for any act or omission of these operators. Any claim you may have about these optional activities and excursions will be against the local operation, not Diamond Dreams Travel.

CONTRAVENTION OF LAW

Diamond Dreams Travel accepts no liability for any loss or damage sustained by a client due to the contravention of the law of the states, countries, or countries where the loss or damage occurred.

ADDITIONAL RISKS

ADDITIONAL RISKS AND DANGERS MAY ARISE, INCLUDING, BUT ARE NOT LIMITED TO, HAZARDS OF TRAVELING IN UNDEVELOPED AREAS, HAZARDS OF TRAVEL BY BOAT, TRAIN, AUTOMOBILE, AIRCRAFT, AND OTHER MEANS OF CONVEYANCE, FORCES OF NATURE, POLITICAL UNREST, OTHER UNREST, HAZARDOUS LOCAL CUSTOMS AND PRACTICES, DIFFERING LEVELS OF SANITATION, DIFFERING STANDARDS OF SAFETY, RISKS ASSOCIATED WITH WATER, FOOD, PLANTS, INSECTS AND DIFFERING ANIMAL REGULATION, ACCIDENT OR ILLNESS IN AREAS LACKING MEANS OF RAPID EVACUATION OR MEDICAL FACILITIES, AND ACTS OF NATIONAL AND LOCAL GOVERNMENTS AND UNREST AND ACTS OF OTHERS AGAINST GOVERNMENTS. THESE RISKS ARE NOT AN EXHAUSTIVE LIST BUT ARE EXAMPLES OF MANY KINDS OF RISKS.

YOU ARE VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH THE KNOWLEDGE THAT THERE ARE SIGNIFICANT DANGERS INVOLVED, AND YOU, WITH THIS, AGREE TO ACCEPT ANY AND ALL RISKS.

AS LAWFUL CONSIDERATION FOR THE AGREEMENT TO PARTICIPATE IN SUCH TRIPS AND ACTIVITIES, YOU AGREE YOU WILL NOT MAKE A CLAIM AGAINST DIAMOND DREAMS TRAVEL OR SUE FOR BODILY INJURY, EMOTIONAL TRAUMA, DEATH, PROPERTY LOSS OR DAMAGE, OR OTHER LOSS, COST, OR EXPENSE, HOWEVER, CAUSED, AS A RESULT OF OR RELATED TO YOUR CONTRACTING FOR, TRAVELING TO OR FROM, OR IN ANY AND EVERY OTHER WAY PARTICIPATING IN THE TOUR. YOU RELEASE DIAMOND DREAMS TRAVEL AND ITS PERSONNEL FROM ANY AND ALL CLAIMS, KNOWN OR UNKNOWN, ARISING FROM CONTRACTING FOR, TRAVELING TO OR FROM, AND IN ANY AND EVERY WAY PARTICIPATING IN A TOUR/TRIP. THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT IS ENTERED INTO ON BEHALF OF YOU AND ALL MEMBERS OF YOUR FAMILY AND PARTY, INCLUDING MINORS ACCOMPANYING YOU. THIS AGREEMENT ALSO BINDS YOUR HEIRS, LEGAL REPRESENTATIVES, AND ASSIGNS.

FORCE MAJEURE

Certain circumstances, called "force majeure" conditions, are unusual circumstances outside the control of DIAMOND DREAMS TRAVEL, which cannot be avoided even if DIAMOND DREAMS TRAVEL acts with all due care. DIAMOND DREAMS TRAVEL is not liable for any loss, damage or expense or any limitation or withdrawal of facilities or services caused by these force majeure conditions, including war, terrorist attack, civil unrest, industrial action, weather, flood, fire, drought, closures, unforeseen alterations of public transport schedules, rescheduling of buses, boats or planes, epidemics, acts of God or any other event outside the control of the company which either delay, extends or reduces the trip or changes the trip after departure.

INDEMNIFICATION

You agree to indemnify us and our affiliates, and any of our Suppliers and any such parties' officers, directors, employees, and agents from and against any claims, causes of action, demands, losses, damages, or other costs (including reasonable legal and accounting fees) brought by you or third parties as a result of your breach of this Agreement, your violation of any law or rights of any third party, or your use of our Website.

REAL ID

Beginning May 3, 2023, if you plan to use your state-issued ID or license to fly within the U.S., you must ensure it is REAL ID-compliant. If you need clarification on whether your ID complies, please get in touch with your local state Department of Motor Vehicles or visit www.tsa.gov/real-id.

The information, products, and services published on this Website may include inaccuracies or typographical errors. Changes are periodically made to the information which appears here.
